1. Definitions

1.2. Client (data subject) – a natural person who visits the online store, registers or makes a purchase.
1.3. Online Store – the Controller’s online store available at https://nanogo.lv.
1.4. Personal data – any information relating to an identified or identifiable natural person (data subject).
1.5. Processing – any operation or set of operations performed on personal data (collection, recording, storage, alteration, use, disclosure, erasure, etc.).
1.6. Cookie – a small text file stored on the Client’s device when visiting the website.
1.7. Direct marketing – activities aimed at offering goods or services and/or ascertaining the Client’s opinion about them.
2. General Provisions
2.1. This Privacy Policy sets out the principles and procedures for the processing of personal data applied by the Controller when the Client uses the services of the Online Store.
2.2. Personal data is processed in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council (General Data Protection Regulation – GDPR), the Law on the Processing of Personal Data of Natural Persons of the Republic of Latvia and other applicable legislation.
2.3. The Controller processes personal data in accordance with the following principles:
2.3.1. lawfully, fairly and transparently in relation to the data subject;
2.3.2. personal data is collected for specified, explicit and legitimate purposes;
2.3.3. processing is adequate, relevant and limited to what is necessary for the purposes of processing;
2.3.4. personal data is accurate and regularly updated;
2.3.5. personal data is stored no longer than necessary for the purposes of processing;
2.3.6. personal data is protected by appropriate technical and organisational measures.
2.4. By making a purchase or registering in the Online Store, the Client confirms that they have read this Privacy Policy.
2.5. The Controller may amend this Privacy Policy. The current version is always available in the Online Store.
3. Purposes, Legal Basis and Scope of Personal Data Processing
3.1. Order Fulfilment (E-commerce)
Purpose: order processing, payment, delivery of goods, customer service.
Legal basis: Article 6(1)(b) GDPR (performance of a contract).
Data processed: first name, last name, e-mail address, phone number, delivery address, IP address, payment data (bank account, payment method), purchase history.
Retention period: 5 (five) years from the last purchase or last login to the Online Store.
3.2. Direct Marketing
Purpose: sending newsletters, offers and promotional information.
Legal basis: Article 6(1)(a) GDPR (Client’s consent).
Data processed: first name, last name, e-mail address, phone number.
Retention period: until withdrawal of consent or 5 (five) years from the last login.
3.3. Accounting and Tax Obligations
Purpose: preparation and storage of accounting documents.
Legal basis: Article 6(1)(c) GDPR (legal obligation).
Retention period: in accordance with the legislation of the Republic of Latvia (up to 10 years).
3.4. Ensuring and Improving Online Store Operations
Purpose: website performance analysis, security, improvement of user experience.
Legal basis: Article 6(1)(f) GDPR (legitimate interests of the Controller).
Data processed: IP address, device data, browsing data, cookie data.
4. Sharing Personal Data with Third Parties
4.1. The Controller may share the Client’s personal data with the following recipients to the extent necessary for the specific purpose:
4.1.1. Delivery service providers: Latvijas Pasts, Omniva, Unisend – for order delivery;
4.1.2. Payment service providers: Montonio Finance UAB (reg. No. 305205122, Konstitucijos pr. 7, Vilnius, Lithuania, compliance@montonio.com, https://montonio.com/lv/) – for payment processing;
4.1.3. IT service providers: hosting, e-mail and analytics service providers – for ensuring website operations;
4.1.4. Public authorities: in cases and in the manner provided for by the legislation of the Republic of Latvia.
4.2. The Controller does not disclose personal data to third parties without a legal basis.
4.3. If personal data is transferred outside the European Economic Area (EEA), the Controller ensures an adequate level of protection in accordance with Chapter V of the GDPR.
5. Data Subject Rights
5.1. The Client as a data subject has the following rights:
5.1.1. Right of access (Article 15 GDPR) – to obtain information on whether and what personal data is being processed and to receive a copy thereof;
5.1.2. Right to rectification (Article 16 GDPR) – to request the correction of inaccurate personal data;
5.1.3. Right to erasure (Article 17 GDPR) – to request the deletion of personal data (“right to be forgotten”) when there is no longer a legal basis for processing;
5.1.4. Right to restriction of processing (Article 18 GDPR) – to request the restriction of personal data processing in certain cases;
5.1.5. Right to data portability (Article 20 GDPR) – to receive personal data in a structured, commonly used and machine-readable format;
5.1.6. Right to object (Article 21 GDPR) – to object to the processing of personal data based on legitimate interests, including for direct marketing purposes;
5.1.7. Right to withdraw consent – where processing is based on consent, the Client may withdraw it at any time, without affecting the lawfulness of processing prior to withdrawal.
5.2. To exercise their rights, the Client sends a request to info@nanogo.lv. The Controller provides a response within 30 (thirty) calendar days of receipt of the request. The Controller may request identity verification before fulfilling the request.
5.3. If the Client believes their rights have been infringed, they have the right to lodge a complaint with the Data State Inspectorate (DVI), address: Elijas iela 17, Rīga, LV-1050, phone: +371 67223131, website: www.dvi.gov.lv.
6. Direct Marketing
6.1. The Client may voluntarily consent to receiving direct marketing communications (newsletters, offers, promotions).
6.2. The Client may withdraw consent to direct marketing at any time:
6.2.1. by sending an e-mail to info@nanogo.lv indicating the withdrawal of consent;
6.2.2. by clicking the “Unsubscribe” link in each received e-mail.
6.3. After withdrawal of consent, the Controller ceases processing personal data for direct marketing purposes, except for notifications related to the fulfilment of an active order.
7. Cookies
7.1. The Online Store uses cookies to ensure website functionality, improve user experience and analyse visit statistics.
7.2. Types of cookies used:
7.2.1. Necessary cookies – ensure basic website functions (login, shopping cart, language selection). Legal basis: Article 6(1)(f) GDPR (legitimate interest).
7.2.2. Analytical cookies – allow analysis of website visits and usability (e.g. Google Analytics). Legal basis: Article 6(1)(a) GDPR (consent).
7.2.3. Marketing cookies – used to display personalised advertising (e.g. Meta Pixel). Legal basis: Article 6(1)(a) GDPR (consent).
7.3. The Client can manage cookie settings using the consent banner displayed on the first visit to the website or by changing browser settings.
7.4. Disabling cookies may affect the functionality of the Online Store.

8. Personal Data Security
8.1. The Controller implements appropriate technical and organisational measures to protect personal data against unauthorised access, accidental or unlawful destruction, alteration, disclosure or other unlawful processing.
8.2. The Client is responsible for the security of their account login credentials (e-mail and password) and must not disclose them to third parties.
9. Final Provisions
9.1. This Privacy Policy has been drawn up and shall be applied in accordance with the GDPR and the legislation of the Republic of Latvia.
9.2. The Controller reserves the right to amend this Privacy Policy. Amendments take effect upon publication in the Online Store.
